A significant shift in workplace equity law is unfolding as the federal government de-emphasizes "disparate impact" claims — lawsuits that challenge hiring practices that disproportionately exclude women or minorities, even if not intentionally. In a recent federal court update, a lawsuit against the Equal Employment Opportunity Commission was dismissed after the agency closed several investigations into such claims. Notably, this included a case involving Amazon delivery targets that a female driver alleged were biased because they did not account for differences in bathroom access. While the Right to Sue remains, the withdrawal of agency support means the burden of proof, and the legal cost, now falls heavily on individual female plaintiffs.
